GENERAL CONDITIONS
These general conditions take care of contractual conditions for all transactions between consumers and LoadKarao.com. All offers and deliveries are only subject to the below sales and delivery conditions. If any stipulation of these general conditions does not apply in the opinion of a judge, for whatever reason, the stipulation in question needs to be replaced by a stipulation based on which parties can still reach their objectives. The remaining stipulations of these general sales and delivery conditions remain in force.
Deviating conditions on the part of the consumer or other agreements that have been concluded are not valid.
By placing your order, you agree to have read these general conditions and our Privacy Statement and you explicitly agree to the contents thereof without further explanation. LoadKarao.com has a right to change its delivery and/or payment terms after termination of the term. Payment orders are at the cost and risk of the one giving the payment order (or authorization). If you are under 18 years old, you need to ask permission from your parents before using LoadKarao.com.
ARTICLE 1: APPLICABILITY OF THESE CONDITIONS
These conditions apply to any offer and any agreement between LoadKarao.com and consumers.
The present conditions also apply to agreements with LoadKarao.com in case third parties need to be involved for the execution.
ARTICLE 2: OFFERS
Price offers and other conditions are assumed to have been accepted by consumers. We try to indicate offered products and prices in a correct way. Typing errors or indicated prices are not binding, however.
ARTICLE 3: DELIVERY
- Consumers are obliged to buy purchased goods at the moment at which these are delivered to them or at the moment at which these become available to them according to the agreement.
- Save as otherwise agreed, the place of delivery is the mobile phone number that was entered by the consumer.
- If necessary, LoadKarao.com is authorized to supply in parts.
- It is the explicit responsibility of the consumer to provide delivery data, such as e-mail address, or mobile phone number. In case of incorrect entry of a recipient mobile phone number, LoadKarao.com will not be held responsible for delivering recharge amount to the incorrect number / mobile wallet. Furthermore, LoadKarao.com cannot and will not reimburse in such cases where consumer provides an incorrect recipient mobile phone number.
- Mobile Credit Recharge - Exception Cast 1: If the mobile phone number, to be recharged, provided by the consumer, is invalid (i.e. a recharge fails), and a payment has been processed for the order, LoadKarao.com team will reach out to the consumer for verification/correction of the mobile phone number at the email address provided at the time of payment. After a verification/correction email is sent by LoadKarao.com, consumer will only have 72 hours to provide LoadKarao.com with the correct mobile phone number. The 72 hour window will start at the moment an email is sent from LoadKarao.com. However, in case the email address provided is also incorrect, or if the consumer doesn’t respond within 72 hours of the email, after retaining a 50% service fee, the remaining 50% of the order amount will be reimbursed to the customer, on the card which was charged to make the initial payment.
- Mobile Wallet Recharge - Exception Cast 1: If the mobile wallet associated with the mobile phone number, to be recharged, provided by the consumer, has been activated but a recharge fails (due to unavailability of vendors, service providers, etc.), and a payment has been processed for the order, LoadKarao.com team will continue to attempt to recharge the Mobile Wallet, and if need be, work with third parties to resolve the issue. During this time, our teams will make reasonable attempts to communicate order statuses, to the person who placed the order (client), but this may not be possible at times when volumes are high, or estimated time of resolution unknown.
- Mobile Wallet Recharge - Exception Cast 2: If the mobile wallet associated with the mobile phone number, to be recharged, provided by the consumer, has not been activated (i.e. a recharge fails), and a payment has been processed for the order, LoadKarao.com team will reach out to the recipient of the mobile wallet recharge (the reciepient), i.e. user of the mobile phone number, provided by the client at the time of payment (i.e. number to be recharged), through an SMS requesting the mobile wallet to be activated by contacting the service provider's customer service. Since it may take up-to 24 hours to activate the mobile wallet, our team will attempt another recharge again after 24 hours. If a recharge fails again, another SMS reminder will be sent to the reciepient. Recharge attempts will be made, and subsequent reminder SMSs will be sent least at the following times: t=0 days (day of order), t = 1 day (the day after order), t=7 days (one week from the day of order), t=14 days (two weeks from the day of order) and t=21 days (three weeks from the day of the order). The last recharge attempt will be made at t=28 days, or four weeks after the original order was placed. If the recharge is unsuccessful again, an email will be sent to the client, which they provided at the time of the order, stating that we will not be attempting further recharges and after retaining a 50% service fee, the remaining 50% of the order amount will be reimbursed to the card which was used to make the initial payment.
- It is the explicit responsibility of the consumer to purchase the right product. Incorrectly purchased orders cannot be exchanged or refunded if the recharge has already been delivered in conformity with article 4, section 1, of these general conditions.
- It is the explicit responsibility of the consumer to provide LoadKarao.com with the correct carrier name at the time of placing an order. Please review the following case to review our standard operating procedure (SOP):
- At the time of order, consumer provides a phone number starting with 0321 (typically a Warid code). However, the consumer chooses Telenor as the service provider. LoadKarao.com team will first attempt to deliver purchased product at the number provided, with Telenor as a service provider. If, however, our attempt at recharge fails, we will attempt to deliver the purchased product at that number with Warid as a service provider. If, however, that fails as well, we will reach out to the customer requesting confirmation/correction and allow for 72 hours for a response. In case of no response, or in case of a response after 72 hours, LoadKarao.com reserves the right to not process the order, and after retaining a 50% service fee, reimburse the remaining 50% of the order amount to the card which was used to make the initial payment.
- It is the explicit responsibility of the consumer to provide LoadKarao.com with the correct Mobile Wallet Account Holder name at the time of placing an order. Please review the following case to review our standard operating procedure (SOP):
- At the time of order, consumer provides a phone number and the first and last names of the Mobile Wallet Account Holder. If, however, upon attempting to recharge the account, our team finds the account holder name to be different, we will abort our attempts at recharging the Mobile Wallet. It must be noted that different spellings are ignored so long as the names provided appear to be the same; for example: Muhammad/Mohammad/Mohamad/Mohammed, Ahmad/Ahmed, etc. are all considered to be the same names. A decision will be made by the LoadKarao.com team whether the names, provided by the client and the service provider, appear to be the same or not. If the names appear to be completely different, LoadKarao.com team will reach out to the customer requesting correction and allow for 72 hours for a response (from the time of the email). In case of no response within 72 hours, or a response after 72 hours, LoalKarao.com reserves the right to retain 50% of the order amount as service fee, and reimburse the remaining 50% of the order amount to the card which was used to make the initial payment. It is important to note that the Loadkarao.com team cannot be held responsible for delivering a recharge to a mobile wallet in the following case: the client provided an incorrect number, who's mobile wallet owner appeared to have a similar name.
- In case of unauthorized use of payment methods (including, among other things, theft, swindling, misappropriation or fraud) LoadKarao.com is authorized to stop delivering products and/or services. In case of suspicion of unauthorized use, LoadKarao.com is authorized to delay delivery of products until a copy of a valid identity document, a copy of a statement of account and a check of the authorized use of the payment method in question by the consumer have been provided by the consumer.
- In case of technical failures, LoadKarao.com is authorized to stop delivering products and/or services. In case an incorrect number of products or products with an incorrect value have been delivered due to failures, consumers are obliged to inform LoadKarao.com thereof and to return any surplus products. If consumers do not return surplus products and/or services, these are considered accepted and can be charged.
- Delivered products or services remain the property of LoadKarao.com until full payment has been made.
- Consumers will receive the following two emails upon placing an order:
- Third party vendor will share a confirmation that the payment was successful
- LoadKarao.com will share a confirmation that the order has been delivered
ARTICLE 4: DELIVERY TIME
- Delivery times indicated by LoadKarao.com are approximates and do not involve final terms, but will never exceed actual delivery times by more than 7 days, save force majeure.
- In case of failed delivery in time, consumers need to give LoadKarao.com notice of default via the contact form and allow LoadKarao.com a reasonable term to meet its obligations after all.
- Delivery times may vary depending on the type of payment method selected. LoadKarao.com will never deliver purchased products/services until full payment has been received on the LoadKarao.com account or payment by credit card is confirmed. If our third party vendors face issues regarding payments, we will work with them to resolve such issues; which may impact service delivery times.
ARTICLE 5: INFORMATION, DATA AND INTELLECTUAL PROPERTY RIGHTS
- General indications and descriptions of items to be delivered by LoadKarao.com, as included in brochures, website, lists and similar items, are only meant as general information instead of quality and/or guarantee indications.
- LoadKarao.com can assume correctness and completeness of information and data provided to LoadKarao.com by consumers.
- Save as otherwise expressly agreed, where appropriate, intellectual property rights to brands, models, drawings, designs, and similar items belong to LoadKarao.com.
ARTICLE 6: GUARANTEE
LoadKarao.com guarantees that our team will do our best, within reason, to deliver the purchased product, at the provided number and carrier, as soon as possible, and share an email receipt at the email address provided at the time of the order.
ARTICLE 7: DEFECTS; COMPLAINTS TERMS
- Consumers need to check (or have checked) purchased goods upon delivery or after that as soon as possible. Consumers need to check whether the delivered goods correspond with the agreement, namely:
- have the correct goods been delivered.
- If there is a shortcoming, it needs to be reported to LoadKarao.com by the consumer within 3 days after delivery. In case of timely notification, LoadKarao.com retains the right to replace the delivered goods or refund the purchase price. Any other liability is excluded.
- LoadKarao.com accepts no liability whatsoever if the above stipulations are not met.
- Delivered goods that have been rejected by consumers can only be returned to LoadKarao.com if prior written consent has been given by LoadKarao.com.
ARTICLE 8: PRICE
- Unless expressly indicated otherwise, consumer prices indicated by LoadKarao.com apply
- in US dollars (USD).
- based on minimum quantities used by LoadKarao.com.
- including delivery costs.
ARTICLE 9: PAYMENT
- Unless agreed otherwise, net payment should be done beforehand. It is not possible to pay on account afterwards.
- Without further notice of default by LoadKarao.com, consumers are assumed to be in default if the amount due has not been paid within the set payment term. Without prejudice to any other LoadKarao.com right, the failure to make payment has at least the following consequences:
- Consumers are not entitled to settle any counterclaim to LoadKarao.com with payment obligations under this agreement.
- In case of bankruptcy or suspension of payment by consumers, LoadKarao.com claims and consumer obligations regarding LoadKarao.com are immediately payable.
ARTICLE 10: LIABILITY
- Liability of LoadKarao.com is limited to redelivering the goods concerned or refunding the purchase price. If decided otherwise, in any case whatsoever, the liability will never exceed 50 dollars per case.
- LoadKarao.com is not liable for indirect or direct damage, including missed profits, mental damage, emotional damage or any other type of damage resulting from LoadKarao.com services.
- In case limited liability is below the level required by law, maximum liability will be limited to the minimum amount allowed by law.
ARTICLE 11: FORCE MAJEURE
- LoadKarao.com has a right to repudiate the agreement entirely or partly or suspend delivery terms, as it chooses, without any obligation to pay damages, in the following cases: Force majeure of any kind whatsoever, mobilization, war, uproar, fire, strikes, transport difficulties, seizure, production interruptions, lack of raw materials and/or energy, disasters, restricting government measures of any kind whatsoever, insufficient performance of company installations that are necessary to observe the agreement, third party supply and service delivery failure, as well as any other circumstance independent of the intention of LoadKarao.com that would have moved LoadKarao.com to abstain from entering into the agreement or to enter into the agreement on different terms if it had been aware thereof.
- LoadKarao.com also has a right to claim force majeure if circumstances that prevent (further) performance appear after LoadKarao.com should have lived up to its commitment.
- During force majeure, the delivery obligations and other obligations of LoadKarao.com are suspended. If the period in which performance of LoadKarao.com obligations is not possible due to force majeure takes longer than weeks, both parties are authorized to repudiate the agreement without any obligation to pay damages.
- During force majeure, LoadKarao.com will try its best to notify and communicate with its consumers around possible delivery times of its services.
ARTICLE 12: DISPUTES
These conditions are subject to Pakistan's law. All disputes, interim proceedings included therein that are related to and/or result from these general conditions, will be dealt with by the Islamabad High Court (in Pakistan), which has jurisdiction, with the proviso that LoadKarao.com also has the right to have disputes dealt with by the competent court of the place of residence of the consumer.
ARTICLE 13: PRIVACY
Data provided by consumers are recorded in the LoadKarao.com customer file. This file also includes data that are necessary to process orders, such as order, delivery and payment data. The customer file is used to execute and process orders.
ARTICLE 14: USE OF SERVICES
Consumers agree that LoadKarao.com services will not be used towards any unlawful activities, including but not limited to money laundering, terrorism or financial frauds.
ARTICLE 15: CHANGE AND LOCATION OF CONDITIONS
The latest registered version or the version valid at the time of concluding the present transaction applies. LoadKarao.com is authorized to change and supplement these general conditions without declaring a reason.
PRIVACY POLICY
LoadKarao.com considers privacy of paramount importance. Therefore, protecting your privacy is very important to us.
This privacy statement describes the way we handle your personal information. This privacy statement includes:
- The type of information we collect
- The way we collect information
- The way we share collected information
- The way we save collected information
WHICH TYPE OF INFORMATION IS COLLECTED
In order to place an order on LoadKarao.com, registration is not required. In order to place an order, you only need to enter the following data:
- The number to be refilled
- Phone carrier associated with the phone number
- Your own e-mail address
- Credit card / payment details
This information is necessary in order to process your order and to prevent fraud with your credit card, for instance. Besides, we can contact you based on these data if something goes wrong with your order or we see suspicious transactions with the data provided by you.
In order to safeguard your privacy, we will save data entered during the order process in our own database. However, this does not include the credit card information provided for payment purposes. A third party financial services firm will consume the credit card information at the time of the order, and will be responsible for its privacy, safety and protection. Saved data (non-financial information) will only be used for LoadKarao.com services or LoadKarao.com commercial actions.
ARTICLE 1: TRANSACTION INFORMATION
As soon as you place an order on LoadKarao.com, all transaction data are saved. Credit card data, for instance, will not be saved by LoadKarao.com itself, but by a secure payment partner (Payment Service Provider). This ensures the fact that these data are only saved in a highly secured database. Besides data provided by you, we will automatically save and use the below information in order to prevent fraud and to deliver our services well:
- Technical data of your computer
- The IP address used to make the transaction
- The country from which the transaction is made
- The way you visit LoadKarao.com
- The browser you use
- The software you use
- Your Internet provider
- The issuing country of the credit card / other payment card
- The site you visited before LoadKarao.com (where you came from)
- The site you visit after LoadKarao.com (where you go to)
- The number of times you visited LoadKarao.com
- The number of transactions you have done
- The products you have bought
- Total value of all your orders
- The carrier of entered mobile phone numbers
- Various other types of personal data to prevent fraud
These data will never be made public on our website and will only be used to prevent fraud, improve our service, and commercial goals for the LoadKarao.com website.
ARTICLE 2: SHARE INFORMATION
LoadKarao.com will only share information with partners that are necessary for processing your order. We will not share personal information with other (commercial) parties without your permission, excluding the below:
- If we are obliged to do so by law (local legislation may vary per state and country). In every case, we will cooperate with official (legal) authorities
- In case of credit card fraud, chargebacks, illegal or otherwise fraudulent transactions, all information will be shared with payment partners, the police, judicial authorities, and other authorities that do research into the transaction(s) concerned. This also goes for transactions that are suspected to be fraudulent
General information, such as visitor numbers, browser use and traffic statistics can be made public at any time. Such information will never lead to individuals being identified.
ARTICLE 3: ADVERTISEMENTS
LoadKarao.com places advertisements on various websites and other types of media on the Internet. LoadKarao.com cannot influence the content, conditions or policies of these websites. We do not check the content of these websites. LoadKarao.com can never be held responsible for the content, offers or other content or promises of third party websites.
ARTICLE 4: CARRIERS / LIABILITY
LoadKarao.com is only a reseller of telecom carriers that are offered on the website. Therefore, LoadKarao.com is not responsible for the conditions and Privacy Policies used by telecom carriers. Particularly, it is not responsible for the durability of call credit, special actions by the carrier, availability of the refill service or other issues LoadKarao.com cannot influence. If you want more information about the carrier you want to refill, always check the website of the carrier concerned.
ARTICLE 5: PERSONAL DATA
LoadKarao.com and its partners only use secure servers for saving personal data and payment details, such as credit card data. All this information is secured using a firewall. You should take into account, however, that risks are always involved when saving data. In case of a security issue, our liability is limited to the description thereof in the LoadKarao.com General Conditions.
ARTICLE 6: PRIVACY POLICY CHANGES
LoadKarao.com has a right to change the Privacy Policy at any time. If this is the case, it will be notified on the website or via e-mail. An updated version of this Privacy Policy can always be found on the LoadKarao.com website. Therefore, you are advised to read the Privacy Policy on a regular basis.
ARTICLE 7: ACCEPT PRIVACY POLICY
The Privacy Policy is part of the LoadKarao.com General Conditions. By placing an order on the LoadKarao.com website, you automatically agree to the LoadKarao.com Privacy Policy and General Conditions. If you do not want to agree to this Privacy Policy or our General Conditions, please do not provide any data to us and do not place any order.
